“Consolidation” refers to multiple shipments of item which are combine into a consolidated shipment.

 

“Service” refers to service provide by Shovice that allowing you to shop at an eligible online merchant’s websites and have the items consolidated at the country and deliver to the address as registered with Shovice or collected by you at the designated self-collection point.

 

“Shipment” means the item being shipped by sea, air or land in any combination to you.

 

“Delivery address” means your local mailing or delivery address as registered with Shovice in your Shovice profile or such other delivery address as registered at check-out on the Shovice website.

 

“GST” refers to goods and services tax, which expression includes any tax, by whatever name called, of a similar nature that may be substituted for it or levied in addition to it.

 

“Member” means the registered Shovice member, whose personal particulars and address are as registered with Shovice at the Shovice website.

 

“Merchant” refers to any online merchants which ships to a Shovice source country, which allows the use of an international credit card and provides the sale of non-prohibited items.

 

“You” and “Your” refers to the member using this service.

 

“Self-collection option” means the option provided by Shovice in selected countries whereby member elects to collect the item at a self-collection point, at a PUDO (by J&T Express) /ninja point (by ninja van) or 45 Jalan pemimpin #09-07

1.     This Website (shovice.com) and the offer of our Services (defined below) are offered on the sole condition of your acceptance without modification of any and all the terms, conditions, and notices. By creating an account on the Website (“Shovice accountAccount “) or by using any Services provided by us, you acknowledge that you have read, understood, and agreed to be bound by the Terms of Service and represent that you have read and understood the same.

 

2.     Despite the transaction occurring on the site, we are not responsible for the accuracy of descriptions, functionality, merchantability and quality of the items you bought from other website(s). You agree that by using the Services, you fully understand the content of the Services in our Quick Guide. The Company will not be liable in any way for any additional requests out of the content of the Services listed. You also agree that you will bear the responsibility for any exporting or importing tax, duty, license, permit, additional processing cost or documents requested by exporting or importing country’s government agency, or any other loss or consequence caused by your items.

 

3.     Displayed Items on our Site.

a.     All information and content related to items on our Site, including but not limited to price, details, dimensions, weight, descriptions, and specifications of the items are translated by us from the information obtained from third party sources and the items or the related information are not owned, manufactured, sold or endorsed by our Company. Considering the technical limitations, we do not warrant that the said information is accurate, complete, reliable, current, or error-free.

 

 

 

4.     Payment

a.     You shall promptly confirm and pay any service charges as specified in the Shovice website which include but are not limited to the following components:

                                                    i.     shipping charges;

                                                   ii.     duties and GST prevailing from time to time, if applicable;

                                                  iii.     holding fees;

                                                 iv.     any additional shipping charges, should the item not comply with the specified guidelines for delivery in order to process the shipping of the item to you; and

                                                  v.     any other charges, if applicable, in order to process the shipping of the item to you.

 

b.     You shall promptly pay all duties and taxes, any additional charges for customs clearance and any other applicable charges imposed by any local or government authority of the destination country, before the item is delivered to your local mailing/delivery address or made available for self-collection at any self-collection point.

c.     Only payment via website or otherwise as may be specified by Shovice will be accepted.

d.     All payment must be made in full. Shovice may detain the item for which such payment has not been made in full until such time full payment is made. We also reserve the right to dispose the item in any manner we deem fit in accordance with these terms and conditions.

 

5.     You shall compensate us for the cost of storage of the said item, shipping charges, storage charges, duties and taxes incurred by us, and all claims, damages, fines and expenses incurred if the shipment/item is deemed prohibited, dangerous and/or illegal. We reserve the right to dispose the item in any manner we deem fit if you fail to make payment of all charges within thirty (30) days of notification to do so.

 

6.     We will notify you of the amount you have to pay for shipping charges, customs clearance charges, GST or other service taxes (if applicable) and any other applicable charges as referred to in payment clause. In providing the service, we act as an independent contractor and we are not an agent of any merchant(s) or act in any other capacity unless otherwise specifically stated.

 

7.     We cannot guarantee the accuracy of product information displayed on our website, including but not limited to price and stock availability. In circumstances where the order cannot be fulfilled by Shovice, it may be cancelled and refunded.

 

8.     By registering for the Services, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the Services’ registration form. Our collection and processing of registration data and certain other information about you are governed by our Privacy Policy.

 

9.     If you commit any breach or violation of any terms and conditions under our Terms of Service, we shall be entitled to immediately terminate our Services, suspend your Shovice Account, and/or may take other legal action at our disposal.

 

10.  Prohibited item:

a.     A Shipment is deemed unacceptable if:

                                                    i.     no customs declaration is made when required by applicable customs regulations,

                                                   ii.     it contains counterfeit goods, animals, bullion, currency, gemstones; weapons, explosives and ammunition; human remains; illegal items, such as ivory and narcotics,

                                                  iii.     it is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), ADR (European Road Transport Regulation on dangerous goods) or other relevant organization (“Dangerous Goods”),

                                                 iv.     its address is incorrect or not properly marked or its packaging is defective or inadequate to ensure safe transportation with ordinary care in handling,

                                                  v.     it contains any other item which Shovice decides cannot be carried safely or legally.

 

 11.  You shall be liable for all loss or damage suffered by us and/or any third party as a result of a breach of this clause.

 

12.  You may also check here to view a list of such unacceptable items which are currently notified to us by the relevant authorities. This list may be amended by the relevant authorities from time to time. We are not responsible for the contents of this list and shall not be held liable for any loss or damage which may be suffered or incurred by you as a result of any inaccuracies or omissions thereof.

 

13.  In order to maintain the integrity of Shovice Services and reputation, Shovice will report any activities pertaining to shipping prohibited items to relevant law enforcement authorities and shipping partners.

15.  Circumstances Beyond Shovice’s Control

a.     Shovice is not liable for any loss or damage arising out of circumstances beyond Shovice’s control. These include but not limited to electrical or magnetic damage to, or erasure of, electronic or photographic images, data or recordings; any defect or characteristic related to the nature of the Shipment, even if known to Shovice. any act or omission by a person not employed or contracted by DHL – e.g., Shipper, Receiver, third party, customs or other government official; “Force Majeure” e.g.,

 

                                               i.     fire, act of God, storm, explosion, earthquake, flood, tempest, accident or other natural disaster;

                                             ii.     war or threat of war, sabotage, insurrection, civil disturbance or requisition;

                                            iii.     acts, restrictions, regulations, bye laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;

                                            iv.     import or export regulations or embargoes;

                                             v.     strikes, lock outs or other industrial actions or trade disputes;

                                            vi.     difficulties in obtaining raw materials, labour, fuel, parts or machinery faced by us or suppliers; or

                                           vii.     telecommunication, transportation, power supply, or system disturbances or failures, or breakdown in machinery resulting in the impossibility of the use of any of the aforementioned.

b.     Shovice will arrange the delivery in a reasonable manner under any uncontrollable circumstance, however Shovice does not have the duty to inform you and will not be responsible for any delay.
